Overview of Design Registration
Design Registration provides a statutory right to the inventor by the government for his/her invention which is either a new process or product. The Registered Design helps the inventor to prevent the third party without authorization from making or manufacturing, using, offering for sale, selling, importing, distributing, and licensing.
The complete Design application is an exclusive legal right given to an inventor. It gives him/her legal authority to exclude others from making, using, selling, and offering for selling or importing a particular invention.
This right remains valid for 20 years, from the date of filing. The holder of the Design is entitled to sue any person who violates the Design and chooses who to sell, grant, or license the Design.

- The Application form should also indicate clearly the source of the geographical origin of any biological material used in the specification.

What is Design Registration?

What is a “design” under Indian law?
A “design” refers to the features of shape, configuration, pattern, or ornament applied to an article by any industrial process or means, which appeal to the eye.
What cannot be registered as a design?
The following are not registrable as designs:
- Functional or mechanical aspects
- Artistic works (protected under Copyright)
- Designs not new or original
- Designs already published in India or elsewhere
- Obscene or scandalous designs
Who can apply for Design Registration?
Any individual, firm, company, or legal entity that is the proprietor of a new or original design can apply. Even foreign nationals or companies can file in India under reciprocity.
Where is a design registered in India?
Designs are registered with the Design Wing of the Patent Office, under the Controller General of Patents, Designs and Trademarks (CGPDTM). The application is filed in Kolkata Patent Office, which handles all design matters in India.
How long is a design valid after registration?
Initially, a registered design is valid for 10 years from the date of registration. It can be renewed for an additional 5 years, making a total validity of 15 years.
What is the time limit to file a design?
The application must be filed before the design is published or disclosed to the public. Public disclosure before filing will make the design ineligible for protection.
What are the documents required for design registration?

What is the government fee for Design Registration?
- For natural person/startup/individual: ₹1,000 (per design)

How long does the registration process take?
The design registration process typically takes 6–12 months, depending on examination and objections, if any. If all documents are in order, registration may be quicker.
Can I use the design before registration?
Yes, you can use the design, but you won’t have legal protection until it’s registered. It’s risky, as someone else may file and register a similar design before you.
What are the rights of a registered design owner?

- Right to license or sell the design to others

Can I claim damages for infringement of design?
Yes. If someone copies your registered design, you can take legal action, including:
- Injunction to stop use

Can I transfer or sell my registered design?
Yes. A registered design is assignable and licensable. It can be transferred through assignment deed, and the transfer must be recorded with the Controller of Designs.
Is there any publication of registered designs?
Yes. After registration, the design is published in the Official Journal of Designs issued by the Patent Office. It allows public access and helps in IP monitoring.
Can I file design registration for multiple views of the same product?
Yes. You can include multiple views (front, top, side, etc.) of the same product in a single design application, as long as it refers to the same design and article.
Can I file a design application online?
Yes. Design applications can be filed online through the official IP India website. You need a Class III Digital Signature and professional agent registration (if applicable).
Can I protect a design internationally with Indian registration?
No. Indian design registration is valid only within India. For global protection, you must file separately in other countries or use the Hague System (if eligible).
What is the classification system in design registration?
India follows the Locarno Classification, which categorizes designs into different classes based on the type of product (e.g., furniture, garments, tools). Applicants must mention the class while filing.
